Fair Determination of Financial Support for Children
Child support is typically determined by the Maryland Child Support Guidelines. However, there may be disputes about the income of each parent, and there are scenarios in which it is appropriate to deviate from the guidelines.
The Law Office of David D. Nowak, LLC , offers knowledgeable counsel and legal advocacy for child support and any related issues of child custody or paternity. Our lawyer has a strong financial background in addition to his focused practice in divorce, custody and family law.
Child Support Disputes in Baltimore City and Baltimore County
The Maryland Child Support Guidelines determine child support from the combined gross incomes of the parents, with credit to each party for payments on the child's behalf for health care, day care and other special needs.
Problems arise if there is a question about either party's income. David Nowak will aggressively investigate any discrepancy between stated income and actual income or questions of potential income. Disputes commonly involve:
- A parent who is self-employed or paid in cash
- A parent who is voluntarily unemployed or underemployed
- Hidden income streams or undeclared windfall
- Substantial change in income (new job or promotion)
High earners also may need legal counsel even when there is no dispute about income. If the combined gross incomes exceed $250,000, a more complicated child support formula applies, based on incomes and opportunities for the child.
We have represented parents on both sides of the child support determination. In representing the recipient parent, we work to verify all sources of income and, if necessary, have the court impute income. In representing the paying parent, we work to keep support obligations fair and reasonable and to ensure that the recipient is accurately reporting income. Because the non-custodial parent typically pays child support to the other party, it is important that custody and child support be considered together.
